Scope of Application

These General Terms and Conditions apply to all contracts concluded between you and IW Vertriebs GmbH via our online shop, unless otherwise agreed in the respective offer.

Conclusion of Contract

The presentation of our products in the online shop does not constitute a legally binding offer, but an non-binding invitation to place an order.

By completing the ordering process, you submit a binding offer to purchase the selected products.

The purchase contract is concluded as soon as we accept your order by means of an order confirmation or by dispatching the goods.

If a payment request is made immediately after the order or the payment process is completed immediately, the contract may already be concluded at this time.

Orders outside the Online Shop

If we offer orders by telephone or in writing via e-mail, the contract is also concluded only through our explicit acceptance or by dispatching the ordered goods.

Contract Language

The contract language is German.

Storage of the Contract Text

We store the contract text in accordance with legal regulations and send you the order data along with the contract information by e-mail.

Registered customers can also view their orders via their customer account, provided that this function is available in the shop.

Correcting Input Errors

Before submitting your order, you will receive an order overview. There you can check all information again and, if necessary, correct it before submitting your order bindingly.

Prices

The prices stated in the online shop at the time of ordering apply.

All prices include the applicable statutory value-added tax.

Any shipping costs incurred will be shown separately during the ordering process. For deliveries outside the European Union, additional import duties, customs duties or other fees of the respective country may apply. These are to be borne by the buyer.

Payment Methods

We offer the payment methods listed in the online shop.

The charge will be made according to the chosen payment method.

You will receive an invoice at the latest with the dispatch of your order in text form.

Shipping Costs

Any shipping costs incurred will be transparently displayed to you before completing your order and are additionally listed in our shipping information.

Delivery

Delivery is carried out by commissioned shipping service providers to the delivery address you provided.

You can find the estimated delivery times on the respective product pages or in our shipping information.

If this is necessary for organizational reasons, we reserve the right to make permissible partial deliveries. You will, of course, not incur any additional shipping costs as a result.

Transfer of Risk

For consumers, the risk of accidental loss or deterioration of the goods passes only upon delivery to the buyer or a person authorized to receive them.

If the buyer acts as an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB), the risk already passes to the buyer upon handover of the goods to the commissioned transport company.

Retention of Title

The delivered goods remain the property of IW Vertriebs GmbH until full payment of the purchase price.

Right of Withdrawal

The statutory right of withdrawal applies exclusively to consumers within the meaning of Section 13 BGB.

A right of withdrawal does not exist, in particular, for goods that have been custom-made for you or clearly tailored to your personal needs.

The right of withdrawal may also expire prematurely in cases regulated by law, for example, for sealed hygiene items after the seal has been broken or for goods that have been inseparably mixed with other goods due to their nature.

Warranty

All items are subject to the statutory warranty rights.

If an additional manufacturer's warranty is granted for individual products, your statutory liability for defects remains unaffected.

Complaints

Your satisfaction is important to us.

Should there ever be cause for complaint, you can contact us at any time by phone or e-mail. We will process your request quickly and with the utmost care.

Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS). Regardless of this, we are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

Packaging Act

We fulfill our legal obligations under the Packaging Act and participate in an approved dual system for the return and recycling of sales packaging.

Choice of Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

If you, as a consumer, have your habitual residence in another state, mandatory consumer protection regulations of that state remain unaffected.

Place of Jurisdiction

If the buyer is a merchant, a legal entity under public law, or a special fund under public law, the registered office of IW Vertriebs GmbH is – as far as legally permissible – the place of jurisdiction for all disputes arising from the contractual relationship.
